Illegal Content Notice and Action Procedure

5.1 Purpose

FindMePlace provides an electronic mechanism for notifying the Operator about specific information on the Service that the reporter considers to be illegal.

The reporting mechanism may be used without creating a FindMePlace account.

5.2 What to include

To help FindMePlace review the report, provide as much of the following information as possible:

  1. the exact URL, listing reference or other precise location of the content;
  2. a clear description of the content;
  3. a sufficiently reasoned explanation of why you consider the content illegal;
  4. any supporting information needed to understand the allegation;
  5. your name and email address where provided/required for the relevant notice;
  6. confirmation that you believe in good faith that the information in the report is accurate and complete.

The Portal may permit an anonymous report. If no contact email is supplied, FindMePlace cannot send the reporter an email confirmation or decision.

Acceptance of an anonymous report by the Portal does not mean that every anonymous submission necessarily contains all elements required for a formal notice under applicable law.

5.3 How FindMePlace handles a report

A human administrator reviews the report. The system records a moderation case/ticket. Possible outcomes include:

  • no action;
  • request for additional information;
  • quarantine/restriction of the listing;
  • removal of the listing;
  • account restriction;
  • another action required by applicable law.

Accepting a report for review does not automatically remove the listing. The moderation decision and the enforcement action are separate steps.

5.4 Confirmation and decision

Where the reporter provides an email address, FindMePlace can send:

  • confirmation that the report was received;
  • the decision and reasons where required/applicable;
  • information about available redress where required by law.

Where a restriction is imposed on user content, the affected user may also receive a statement of reasons where required by applicable law.

5.5 Manual moderation

FindMePlace currently does not use AI or an automated content-classification system to make moderation decisions. Decisions are made by a human administrator.

5.6 Evidence and audit trail

FindMePlace may retain the report, decision, reason, timestamps, listing reference and related evidence separately from the underlying listing in order to:

  • demonstrate how the report was handled;
  • comply with legal obligations;
  • prevent abuse;
  • handle disputes;
  • establish, exercise or defend legal claims.

Deletion of the listing does not necessarily delete the moderation case.
